New Legislation Regarding Your HOA

Dear Memorial Chase Homeowners’ Association, Inc. Owners:

Recently the State of Texas passed new policies amending Chapter 209 of the Texas Property Code effective January 1, 2012, which requires the Memorial Chase Homeowners’ Association, Inc. to adopt, and record policies and regulations. This article is to notify and inform you of the new policies regarding Board Meetings.

Associations are now required to provide more information to Owners about Board Meetings, including providing owners with meeting information. To comply with the new laws, effective January 1, 2012, the Board of Directors chose to provide notice of Memorial Chase Homeowners Association, Inc. formal meetings by posting the notices outside the on-site office, by posting the notices on the Memorial Chase Homeowners Association, Inc. website (www.memorialchasehoa.com) and by emailing a meeting notice to Owners who have registered their email address.

PLEASE NOTE, the new legislation, Sec. 209.0051, Subsection (e) (2) (B) of the Texas Residential Property Owners Protection Act, allows “sending notice by email to each owner who has registered an email address with the association.” Per Sec. 209.0051 Subsection (f), “it is an owner’s duty to keep an updated email registered with the property owners’ association.”
